Decriminalization: The $100 Line

Since Question 2 passed in 2008, possession of one ounce or less by anyone — regardless of age — is a civil violation punishable by a $100 fine only. No arrest, no criminal record, no court appearance. This applies even to individuals under 21, though minors face an additional mandatory drug awareness program requirement.

For adults 21+, possession of one ounce or less is fully legal under Question 4 and carries no penalty at all. The $100 civil fine applies only to those under 21 or to adults possessing legal amounts in prohibited locations.

Public Consumption

Smoking or vaping cannabis in any public place is a civil violation carrying a $100 fine. This includes sidewalks, parks, beaches, public transit, restaurants, and any other publicly accessible space. The fine structure mirrors the pre-legalization decriminalization penalty.

Open Container in a Vehicle

Cannabis open container laws mirror alcohol rules. Any open package of cannabis or cannabis product within the passenger area of a vehicle carries a $500 fine. Cannabis must be transported in its original sealed packaging or in a closed container in the trunk or other area not accessible to the driver or passengers.

Trafficking Mandatory Minimums

Massachusetts retains harsh mandatory minimum sentences for large-scale cannabis trafficking under MGL Ch. 94C. The thresholds are weight-based:

  • 50–100 lbs: 2.5-year mandatory minimum
  • 100–2,000 lbs: 3.5-year mandatory minimum
  • 2,000–10,000 lbs: 5-year mandatory minimum
  • 10,000+ lbs: 8-year mandatory minimum

These mandatory minimums cannot be reduced by judges and apply even to first-time offenders. They predate legalization and remain on the books despite the legal recreational market.

Unlicensed Sales

Operating without a CCC license is a serious offense. Even small-quantity unlicensed sales can result in up to 2 years incarceration and $5,000 in fines. The penalties escalate sharply for larger operations and repeat offenses.

School Zone Enhancements

Cannabis offenses committed within 1,000 feet of a school carry enhanced penalties, including mandatory minimum sentences for distribution. This provision has been controversial in urban areas like Boston, where school zones overlap with much of the city's commercial district.
